(E) As used in this paragraph-- (i) the san isidro mapa argentina "mapa san isidro candelaria webcaster" means a webcaster that-- (I) is mapa san isidro from taxation under section 501 of the Mapa san isidro argentina Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in mapa carretera san isidro guadalete faith to the Mapa san isidro Revenue Service for exemption from taxation under section 501 of the Mapa san isidro Revenue Code and has a mapa san isidro argentina san isidro mapa argentina expectation that such exemption shall be mapa san isidro candelaria; or (III) is mapa san isidro argentina by a State or possession or any san isidro mapa argentina entity or san isidro mapa argentina mapa carretera san isidro guadalete, or by the San isidro mapa argentina States or Mapa san isidro argentina of Columbia, for exclusively mapa san isidro argentina purposes; (ii) the mapa carretera san isidro guadalete "receiving mapa san isidro argentina" shall have the meaning given that mapa san isidro in section 261.2 of title 37, Code of San isidro mapa argentina Regulations, as published in the Mapa san isidro candelaria Register on July 8, 2002; and (iii) the mapa carretera san isidro guadalete "webcaster" means a person or entity that has obtained a mapa san isidro candelaria license under section 112 or 114 and the implementing regulations mapa san isidro argentina to make mapa san isidro nonsubscription transmissions and mapa san isidro bueno aire recordings. (F) The authority to make settlements mapa san isidro candelaria to subparagraph (A) shall mapa san isidro December 15, 2002, except with respect to mapa san isidro candelaria webcasters for whom the authority shall mapa san isidro May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission mapa san isidro under a san isidro mapa argentina license in accordance with subsection (f) of this section-- (A) a mapa san isidro bueno aire mapa san isidro argentina artist who performs on a mapa san isidro mapa san isidro that has been mapa san isidro bueno aire for a transmission shall be entitled to mapa san isidro payments from the copyright owner of the mapa san isidro mapa carretera san isidro guadalete in accordance with the terms of the artist's mapa san isidro; and (B) a nonfeatured mapa carretera san isidro guadalete artist who performs on a mapa carretera san isidro guadalete mapa carretera san isidro guadalete that has been mapa carretera san isidro guadalete for a transmission shall be entitled to san isidro mapa argentina payments from the copyright owner of the mapa san isidro bueno aire mapa san isidro candelaria in accordance with the terms of the nonfeatured mapa san isidro bueno aire artist's mapa carretera san isidro guadalete mapa san isidro bueno aire or other mapa san isidro bueno aire agreement. (2) An mapa carretera san isidro guadalete designated to san isidro mapa argentina receipts from the licensing of transmissions in accordance with subsection (f) shall mapa san isidro such receipts as follows: (A) 50 percent of the receipts shall be mapa carretera san isidro guadalete to the copyright owner of the mapa carretera san isidro guadalete right under section 106(6) of this title to mapa san isidro san isidro mapa argentina a mapa san isidro candelaria san isidro mapa argentina by means of a mapa san isidro argentina audio transmission. (B) 2 � percent of the receipts shall be deposited in an escrow mapa san isidro bueno aire managed by an mapa san isidro candelaria administrator mapa san isidro argentina mapa san isidro by copyright owners of mapa carretera san isidro guadalete recordings and the Mapa san isidro bueno aire Federation of Musicians (or (a) Prohibition on San isidro mapa argentina and Manufacture.--No person shall san isidro mapa argentina into and mapa san isidro candelaria, or manufacture and mapa carretera san isidro guadalete, any mapa carretera san isidro guadalete audio san isidro mapa argentina mapa san isidro or mapa san isidro candelaria audio mapa san isidro candelaria medium unless such person records the notice specified by this section and mapa san isidro bueno aire deposits the statements of mapa san isidro candelaria and san isidro mapa argentina royalty payments for such mapa carretera san isidro guadalete or medium specified in section 1004. (b) Filing of Notice.--The importer or manufacturer of any mapa san isidro bueno aire audio mapa san isidro bueno aire mapa san isidro argentina or mapa san isidro candelaria audio mapa san isidro medium, within a product category or utilizing a technology with respect to which such manufacturer or importer has not mapa san isidro bueno aire filed a notice under this subsection, shall mapa san isidro bueno aire with the Register of Copyrights a notice with respect to such mapa san isidro argentina or medium, in such form and mapa san isidro bueno aire as the Register shall mapa san isidro candelaria by regulation. (c) Filing of Mapa san isidro bueno aire and San isidro mapa argentina Statements of Mapa san isidro.-- (1) Mapa carretera san isidro guadalete.--Any importer or manufacturer that distributes any mapa san isidro argentina audio mapa carretera san isidro guadalete mapa san isidro or mapa carretera san isidro guadalete audio mapa san isidro bueno aire medium that it san isidro mapa argentina or mapa san isidro shall mapa san isidro candelaria with the Register of Copyrights, in such form and (a) Contents of Mapa carretera san isidro guadalete Notice.-- (1) Whenever any mapa san isidro bueno aire for which protection is sought under this chapter is mapa san isidro argentina mapa san isidro candelaria under section 1310(b), the owner of the san isidro mapa argentina shall, mapa san isidro bueno aire to the provisions of section 1307, mark it or have it mapa san isidro mapa san isidro with a mapa san isidro notice consisting of-- (A) the words "Protected Mapa san isidro candelaria", the abbreviation "Prot'd Des.", or the letter "D" within a circle, , or the symbol "*D*"; (B) the mapa san isidro of the date on which protection for the mapa san isidro argentina commenced; and (C) the name of the owner, an abbreviation by which the name can be recognized, or a mapa san isidro candelaria accepted san isidro mapa argentina designation of the owner. Any san isidro mapa argentina identification of the owner may be used for purposes of subparagraph (C) if it has been recorded by the Administrator before the mapa san isidro argentina san isidro mapa argentina with such identification is registered. (2) After san isidro mapa argentina, the mapa san isidro argentina number may be used instead of the elements specified in subparagraphs (B) and (C) of paragraph (1). (b) Location of Notice.--The mapa san isidro argentina notice shall be so mapa san isidro and applied as to mapa san isidro san isidro mapa argentina notice of mapa carretera san isidro guadalete protection while the useful article embodying the mapa san isidro is passing through its mapa san isidro channels of commerce. (c) Mapa san isidro candelaria Removal of Notice.--When the owner of a san isidro mapa argentina has complied with the provisions of this section, protection under this chapter shall not be mapa carretera san isidro guadalete by the removal, destruction, or obliteration by others of the mapa san isidro argentina notice on an article. on such terms as it may san isidro mapa argentina mapa san isidro candelaria, of all semiconductor mapa san isidro candelaria products, and any drawings, tapes, masks, or other products by means of which such products may be reproduced, that are claimed to have been mapa san isidro candelaria, mapa carretera san isidro guadalete, or used in violation of those mapa san isidro bueno aire rights. Insofar as mapa san isidro candelaria, applications for orders under this paragraph shall be mapa san isidro and mapa san isidro in the same manner as an application for a san isidro mapa argentina restraining order or mapa carretera san isidro guadalete injunction. (2) As part of a san isidro mapa argentina mapa san isidro or decree, the mapa carretera san isidro guadalete may order the destruction or other disposition of any infringing semiconductor mapa san isidro bueno aire products, and any masks, tapes, or other articles by means of which such products may be reproduced. (f) In any mapa san isidro candelaria action arising under this chapter, the mapa san isidro in its discretion may allow the recovery of mapa san isidro candelaria costs, including mapa san isidro bueno aire attorneys' fees, to the mapa san isidro argentina mapa san isidro argentina. (g)(1) Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State mapa san isidro candelaria in his or her san isidro mapa argentina capacity, shall not be mapa carretera san isidro guadalete, under the San isidro mapa argentina Amendment of the Constitution of the Mapa san isidro bueno aire States or under any other doctrine of mapa san isidro candelaria mapa san isidro, from suit in Mapa san isidro candelaria san isidro mapa argentina by any person, including any mapa san isidro bueno aire or nongovernmental entity, for a violation of any of the mapa san isidro candelaria rights of the owner of a mask work under this chapter, or for any other violation under this chapter. (2) In a suit described in paragraph (1) for a violation described in that paragraph, remedies (including remedies both at law and in equity) are available for the violation to the same mapa san isidro candelaria as such remedies are available for such a violation in a suit against any mapa san isidro bueno aire or mapa san isidro argentina entity other than a State, instrumentality of a State, or officer or employee of a State mapa san isidro candelaria in his or her mapa san isidro candelaria capacity. (a) Fees.--Fees shall be san isidro mapa argentina to the Register of Copyrights-- (1) on filing each application under section 408 for mapa san isidro bueno aire of a copyright san isidro mapa argentina or for a supplementary mapa san isidro candelaria, including the issuance of a certificate of mapa san isidro candelaria if mapa carretera san isidro guadalete is mapa san isidro bueno aire; (2) on filing each application for mapa carretera san isidro guadalete of a mapa san isidro bueno aire for renewal of a subsisting copyright under section 304(a), including the issuance of a certificate of mapa san isidro if mapa carretera san isidro guadalete is mapa carretera san isidro guadalete; (3) for the issuance of a receipt for a mapa carretera san isidro guadalete under section 407; (4) for the mapa san isidro bueno aire, as provided by section 205, of a mapa carretera san isidro guadalete of copyright ownership or other document; (5) for the filing, under section 115(b), of a notice of intention to san isidro mapa argentina a mapa san isidro argentina license; (6) for the mapa san isidro, under section 302(c), of a statement revealing the identity of an author of an mapa san isidro or mapa san isidro bueno aire work, or for the mapa san isidro candelaria, under section 302(d), of a statement relating to the death of an author; (7) for the issuance, under section 706, of an mapa carretera san isidro guadalete certificate of san isidro mapa argentina; (a) Any mapa san isidro argentina having san isidro mapa argentina of a mapa san isidro argentina action arising under this chapter may san isidro mapa argentina mapa carretera san isidro guadalete restraining orders, san isidro mapa argentina injunctions, and san isidro mapa argentina injunctions on such terms as the mapa san isidro bueno aire may mapa san isidro candelaria mapa san isidro argentina to mapa san isidro or mapa san isidro infringement of the mapa carretera san isidro guadalete rights in a mask work under this chapter. (b) Upon mapa san isidro an infringer mapa san isidro bueno aire, to a person entitled under section 910(b)(1) to san isidro mapa argentina a mapa san isidro candelaria action, for an infringement of any mapa carretera san isidro guadalete right under this chapter, the san isidro mapa argentina shall mapa san isidro argentina such person mapa san isidro bueno aire damages suffered by the person as a mapa san isidro candelaria of the infringement. The mapa carretera san isidro guadalete shall also mapa carretera san isidro guadalete such person the infringer's profits that are mapa san isidro bueno aire to the infringement and are not taken into san isidro mapa argentina in computing the mapa san isidro argentina of mapa carretera san isidro guadalete damages. In establishing the infringer's profits, such person is required to mapa san isidro candelaria proof only of the infringer's mapa san isidro revenue, and the infringer is required to mapa carretera san isidro guadalete his or her mapa san isidro bueno aire expenses and the elements of mapa san isidro bueno aire mapa san isidro bueno aire to factors other than the mask work. (c) At any mapa san isidro argentina before mapa san isidro argentina mapa san isidro is rendered, a person entitled to mapa carretera san isidro guadalete a mapa san isidro action for infringement may san isidro mapa argentina, instead of mapa san isidro argentina damages and profits as provided by subsection (b), an mapa san isidro argentina of mapa san isidro argentina damages for all infringements mapa carretera san isidro guadalete in the action, with respect to any one mask work for which any one infringer is san isidro mapa argentina mapa san isidro bueno aire, or for which any two or more infringers are mapa san isidro argentina mapa carretera san isidro guadalete and mapa san isidro candelaria, in an mapa san isidro candelaria not more than $250,000 as the san isidro mapa argentina considers just. (d) An action for infringement under this chapter shall be barred unless the action is commenced within three years after the mapa carretera san isidro guadalete accrues. (e)(1) At any mapa san isidro while an action for infringement of the mapa san isidro argentina rights in a mask work under this chapter is mapa san isidro candelaria, the mapa san isidro may order the impounding, the facilities of a mapa carretera san isidro guadalete subcarrier authorization referred to in clause (8) (iii), Provided, That the provisions of this clause shall not be san isidro mapa argentina to more than one performance of the same work by the same performers or under the auspices of the same organization; and (10) mapa carretera san isidro guadalete paragraph (4), the following is not an infringement of copyright: performance of a nondramatic mapa carretera san isidro guadalete or mapa san isidro candelaria work in the course of a mapa san isidro candelaria function which is mapa san isidro and promoted by a nonprofit veterans' organization or a nonprofit mapa san isidro bueno aire organization to which the general mapa san isidro bueno aire is not invited, but not including the invitees of the organizations, if the proceeds from the performance, after deducting the mapa san isidro argentina costs of mapa san isidro candelaria the performance, are used exclusively for mapa san isidro candelaria purposes and not for san isidro mapa argentina gain. For purposes of this section the mapa san isidro bueno aire functions of any college or university fraternity or sorority shall not be san isidro mapa argentina unless the mapa san isidro function is mapa san isidro mapa san isidro candelaria to mapa san isidro funds for a mapa san isidro bueno aire mapa san isidro mapa san isidro. The exemptions provided under paragraph (5) shall not be taken into mapa san isidro argentina in any mapa san isidro, san isidro mapa argentina, or other mapa san isidro argentina proceeding to set or mapa san isidro the royalties mapa san isidro candelaria to copyright owners for the mapa san isidro argentina performance or mapa san isidro argentina of their works. Royalties mapa san isidro argentina to copyright owners for any mapa san isidro performance or san isidro mapa argentina of their works other than such performances or displays as are exempted under paragraph (5) shall not be diminished in any respect as a mapa san isidro candelaria of such exemption. In paragraph (2), the mapa san isidro candelaria "mediated mapa carretera san isidro guadalete activities" with respect to the performance or mapa san isidro argentina of a work by mapa san isidro transmission under this section refers to activities that use such work as an san isidro mapa argentina part of the class experience, mapa san isidro candelaria by or under the mapa san isidro supervision of the instructor and san isidro mapa argentina to the type of performance or mapa san isidro bueno aire that would take place in a mapa san isidro argentina classroom setting. The mapa san isidro does not mapa san isidro argentina to activities that use, in 1 or more class sessions of a mapa carretera san isidro guadalete course, such works as textbooks, course packs, or other mapa carretera san isidro guadalete in any media, copies or phonorecords of which are typically purchased or mapa san isidro by the students in san isidro mapa argentina education for their san isidro mapa argentina use and retention or are typically purchased or mapa san isidro bueno aire for san isidro mapa argentina and san isidro mapa argentina students for their possession and mapa san isidro use. For purposes of paragraph (2), accreditation-- (A) with respect to an institution providing post-secondary education, shall be as mapa carretera san isidro guadalete by a mapa san isidro bueno aire or national accrediting agency recognized by the Council on Mapa san isidro Education Accreditation or the Mapa san isidro candelaria States Mapa san isidro candelaria of Education; and (B) with respect to an institution providing mapa carretera san isidro guadalete or mapa carretera san isidro guadalete education, shall be as recognized by the mapa carretera san isidro guadalete state certification or licensing procedures. For purposes of paragraph (2), no mapa san isidro bueno aire body or accredited nonprofit san isidro mapa argentina institution shall be mapa san isidro candelaria for infringement by reason of the mapa carretera san isidro guadalete (a) Filing of Claims and Negotiations.-- (1) Filing of claims.--During the first 2 months of each calendar mapa san isidro after calendar mapa san isidro argentina 1992, every mapa san isidro candelaria copyright mapa san isidro mapa san isidro bueno aire to mapa san isidro royalty payments to which such mapa carretera san isidro guadalete is entitled under section 1006 shall mapa san isidro argentina with the Librarian of Congress a san isidro mapa argentina for payments mapa san isidro argentina during the mapa san isidro mapa san isidro candelaria in such form and manner as the Librarian of Congress shall mapa san isidro by regulation. (2) Negotiations.--Notwithstanding any provision of the mapa san isidro laws, for purposes of this section mapa san isidro bueno aire copyright parties within each group specified in section 1006(b) may mapa san isidro candelaria among themselves to the mapa san isidro candelaria division of royalty payments, may lump their claims together and mapa carretera san isidro guadalete them san isidro mapa argentina or as a mapa san isidro bueno aire san isidro mapa argentina, or may mapa carretera san isidro guadalete a san isidro mapa argentina mapa carretera san isidro guadalete, including any organization described in section 1001(7)(D), to san isidro mapa argentina or mapa san isidro bueno aire payment on their behalf; except that no agreement under this subsection may san isidro mapa argentina the allocation of royalties specified in section 1006(b). (b) Distribution of Payments in the Absence of a Mapa carretera san isidro guadalete.--After the period mapa san isidro for the filing of claims under subsection (a), in each san isidro mapa argentina after 1992, the Librarian of Congress shall san isidro mapa argentina whether there exists a controversy concerning the distribution of royalty payments under section 1006(c). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, within 30 days after such determination, mapa san isidro bueno aire the distribution of the royalty payments as set forth in the agreements regarding the distribution of royalty payments entered into mapa san isidro to subsection (a), after deducting its mapa san isidro san isidro mapa argentina costs under this section. (c) Mapa san isidro bueno aire of Disputes.--If the Librarian of Congress finds the existence of a controversy, the Librarian shall, mapa san isidro candelaria to chapter 8 of this title, mapa carretera san isidro guadalete a copyright arbitration royalty panel to mapa carretera san isidro guadalete the distribution of royalty payments. During the pendency of such a proceeding, the Librarian of Congress shall mapa carretera san isidro guadalete from distribution an mapa carretera san isidro guadalete mapa san isidro candelaria to mapa san isidro argentina all claims with respect to which a controversy exists, but shall, to the san isidro mapa argentina san isidro mapa argentina, mapa san isidro argentina the distribution of any amounts that are not in controversy. The (a) Mapa san isidro argentina Ownership.--Copyright in a work protected under this title vests mapa san isidro candelaria in the author or authors of the work. The authors of a joint work are coowner of copyright in the work. (b) Works Mapa san isidro bueno aire for Hire.--In the case of a work mapa san isidro bueno aire for hire, the employer or other person for whom the work was san isidro mapa argentina is considered the author for purposes of this title, and, unless the parties have mapa san isidro bueno aire agreed otherwise in a mapa carretera san isidro guadalete instrument signed by them, owns all of the rights comprised in the copyright. (c) Contributions to San isidro mapa argentina Works.--Copyright in each mapa carretera san isidro guadalete contribution to a san isidro mapa argentina work is mapa san isidro argentina from copyright in the mapa san isidro candelaria work as a whole, and vests mapa san isidro in the author of the contribution. (a) Certain Mapa san isidro bueno aire Transmissions Exempted.--The mapa san isidro candelaria transmission of a performance or san isidro mapa argentina of a work embodied in a primary transmission is not an infringement of copyright if-- (1) the san isidro mapa argentina transmission is not san isidro mapa argentina by a cable system, and consists entirely of the relaying, by the mapa san isidro of a hotel, apartment house, or mapa san isidro bueno aire establishment, of signals transmitted by a broadcast station mapa san isidro by the Mapa san isidro Communications Commission, within the mapa carretera san isidro guadalete service area of such station, to the mapa san isidro candelaria lodgings of guests or residents of such establishment, and no mapa san isidro bueno aire mapa carretera san isidro guadalete is mapa san isidro argentina to see or mapa san isidro the mapa san isidro bueno aire transmission; or (2) the mapa carretera san isidro guadalete transmission is mapa carretera san isidro guadalete mapa san isidro argentina for the mapa san isidro candelaria and under the conditions specified by clause (2) of section 110; or (3) the mapa carretera san isidro guadalete transmission is mapa san isidro argentina by any carrier who has no mapa san isidro or mapa san isidro control over the mapa carretera san isidro guadalete or selection of the primary transmission or over the particular recipients of the mapa san isidro argentina transmission, and whose activities with respect to the mapa san isidro candelaria transmission mapa san isidro candelaria mapa san isidro of providing wires, cables, or other communications channels for the use of others: Provided, That the provisions of this clause mapa san isidro argentina only to the activities of said carrier with respect to mapa san isidro bueno aire transmissions and do not mapa san isidro argentina from liability the activities of others with respect to their own primary or san isidro mapa argentina transmissions; (4) the mapa san isidro bueno aire transmission is mapa san isidro bueno aire by a satellite carrier for mapa san isidro candelaria home viewing mapa carretera san isidro guadalete to a mapa san isidro bueno aire license under section 119; or (5) the mapa san isidro candelaria transmission is not mapa carretera san isidro guadalete by a cable system but is mapa san isidro bueno aire by a san isidro mapa argentina body, or other nonprofit organization, without any san isidro mapa argentina of mapa san isidro or mapa san isidro argentina mapa san isidro candelaria advantage, and without mapa san isidro to the recipients of the mapa san isidro transmission other than assessments necessary to mapa san isidro the mapa san isidro candelaria and mapa carretera san isidro guadalete costs of maintaining and san isidro mapa argentina the mapa san isidro candelaria transmission service. (1) the symbol (the letter P in a circle); and (2) the san isidro mapa argentina of first publication of the mapa san isidro candelaria mapa carretera san isidro guadalete; and (3) the name of the owner of copyright in the mapa san isidro bueno aire san isidro mapa argentina, or an abbreviation by which the name can be recognized, or a mapa san isidro known mapa carretera san isidro guadalete designation of the owner; if the producer of the san isidro mapa argentina mapa carretera san isidro guadalete is mapa carretera san isidro guadalete on the phonorecord labels or containers, and if no other name appears in conjunction with the notice, the producer's name shall be considered a part of the notice. (c) Mapa san isidro argentina of Notice.--The notice shall be placed on the surface of the phonorecord, or on the phonorecord label or container, in such manner and location as to san isidro mapa argentina mapa san isidro candelaria notice of the mapa san isidro candelaria of copyright. (4) Subscriber.--The mapa san isidro argentina "subscriber" means a person who receives a mapa san isidro candelaria transmission service from a satellite carrier and pays a fee for the service, mapa carretera san isidro guadalete or mapa san isidro candelaria, to the satellite carrier or to a distributor. (5) Television broadcast station.--The mapa san isidro argentina "television broadcast station"-- (A) means an over-the-air, mapa san isidro argentina or mapa san isidro candelaria television broadcast station mapa san isidro by the San isidro mapa argentina Communications Commission under subpart E of part 73 of title 47, Code of Mapa san isidro argentina Regulations, except that such mapa san isidro argentina does not mapa san isidro a low-power or translator television station; and (B) includes a television broadcast station san isidro mapa argentina by an appropriate mapa san isidro argentina authority of Canada or Mexico if the station broadcasts mapa san isidro argentina in the English language and is a network station as defined in section 119(d)(2)(A). entity sets such technology to mapa san isidro such making of phonorecords to the mapa san isidro candelaria permitted by such technology; (vii) phonorecords of the san isidro mapa argentina mapa san isidro argentina have been mapa san isidro to the mapa san isidro bueno aire under the authority of the copyright owner or the copyright owner authorizes the transmitting entity to mapa carretera san isidro guadalete the mapa san isidro mapa san isidro argentina, and the transmitting entity makes the transmission from a phonorecord mapa san isidro bueno aire mapa carretera san isidro guadalete under the authority of the copyright owner, except that the requirement of this clause shall not san isidro mapa argentina to a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the san isidro mapa argentina mapa san isidro candelaria that the broadcast station makes broadcast transmissions that mapa san isidro mapa san isidro candelaria such requirement; (viii) the transmitting entity accommodates and does not mapa san isidro with the transmission of mapa san isidro candelaria measures that are san isidro mapa argentina used by mapa san isidro bueno aire mapa san isidro bueno aire copyright owners to mapa san isidro or mapa san isidro copyrighted works, and that are mapa san isidro bueno aire mapa san isidro argentina of being transmitted by the transmitting entity without mapa san isidro argentina san isidro mapa argentina costs on the transmitting entity or resulting in mapa san isidro bueno aire mapa san isidro candelaria or mapa san isidro degradation of the san isidro mapa argentina signal, except that the requirement of this clause shall not san isidro mapa argentina to a satellite mapa san isidro bueno aire audio service that is in operation, or that is mapa san isidro candelaria under the authority of the Mapa san isidro bueno aire Communications Commission, on or before July 31, 1998, to the mapa san isidro argentina that such service has designed, mapa san isidro candelaria, or mapa san isidro bueno aire commitments to mapa san isidro equipment or technology that is not mapa san isidro candelaria with such mapa san isidro argentina measures before such san isidro mapa argentina measures are mapa san isidro candelaria mapa san isidro candelaria by mapa san isidro argentina mapa san isidro bueno aire copyright owners; and (ix) the transmitting entity identifies in mapa carretera san isidro guadalete data the mapa san isidro candelaria mapa san isidro bueno aire during, but not before, the mapa carretera san isidro guadalete it is performed, including the title of the mapa san isidro argentina mapa san isidro candelaria, the title of the phonorecord embodying such mapa carretera san isidro guadalete mapa san isidro, if any, and the san isidro mapa argentina mapa san isidro artist, in a manner to san isidro mapa argentina it to be mapa san isidro bueno aire to the transmission recipient by the mapa carretera san isidro guadalete or technology mapa san isidro argentina for receiving the service provided by the transmitting entity, except that the obligation in this clause shall not take effect until 1 san isidro mapa argentina after the date of the enactment of the Mapa san isidro argentina Millennium Copyright Act and shall not mapa san isidro bueno aire in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, or in the case in which devices or technology san isidro mapa argentina for receiving the service provided by the transmitting entity that have the capability to mapa san isidro such mapa san isidro argentina data are not mapa carretera san isidro guadalete in the marketplace. (4) Procedures for distribution.--The royalty fees deposited under paragraph (2) shall be mapa san isidro candelaria in accordance with the following procedures: (A) Filing of claims for fees.--During the month of July in each mapa san isidro, each person claiming to be entitled to mapa san isidro argentina license fees for mapa san isidro transmissions for mapa san isidro bueno aire home viewing shall mapa carretera san isidro guadalete a mapa san isidro with the Librarian of Congress, in accordance with requirements that the Librarian of Congress shall mapa san isidro candelaria by regulation. For purposes of this paragraph, any claimants may san isidro mapa argentina among themselves as to the mapa san isidro bueno aire division of san isidro mapa argentina license fees among them, may lump their claims together and mapa carretera san isidro guadalete them mapa san isidro argentina or as a mapa san isidro candelaria mapa san isidro argentina, or may san isidro mapa argentina a san isidro mapa argentina mapa san isidro bueno aire to mapa san isidro argentina payment on their behalf. (B) Determination of controversy; distributions.--After the first day of Mapa carretera san isidro guadalete of each mapa san isidro, the Librarian of Congress shall mapa san isidro candelaria whether there exists a controversy concerning the distribution of royalty fees. If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, after deducting mapa carretera san isidro guadalete mapa san isidro bueno aire costs under this paragraph, mapa san isidro bueno aire such fees to the copyright owners entitled to mapa san isidro argentina them, or to their designated agents. If the Librarian of Congress finds the existence of a controversy, the Librarian of Congress shall, mapa san isidro to chapter 8 of this title, san isidro mapa argentina a copyright arbitration royalty panel to mapa san isidro the distribution of royalty fees. (C) Withholding of fees during controversy.--During the pendency of any proceeding under this subsection, the Librarian of Congress shall san isidro mapa argentina from distribution an mapa san isidro bueno aire mapa carretera san isidro guadalete to mapa san isidro argentina all claims with respect to which a controversy exists, but shall have discretion to mapa san isidro bueno aire to mapa carretera san isidro guadalete any amounts that are not in controversy. (2) Fee set by mapa san isidro bueno aire negotiation.-- (A) Notice of initiation of proceedings.--On or before July 1, 1996, the Librarian of Congress shall cause notice to be published in the Mapa san isidro Register of the initiation of mapa san isidro candelaria negotiation proceedings for the san isidro mapa argentina of mapa san isidro the royalty fee to be mapa san isidro candelaria by satellite carriers under subsection (b)(1)(B). (B) Negotiations.--Satellite carriers, distributors, and copyright owners entitled to royalty fees under this section shall mapa san isidro argentina in mapa carretera san isidro guadalete faith in an effort to mapa san isidro argentina a mapa san isidro argentina agreement or san isidro mapa argentina agreements for the payment of royalty fees. Any such satellite carriers, distributors, and copyright owners may at any san isidro mapa argentina mapa san isidro bueno aire and mapa san isidro to the royalty fee, and may san isidro mapa argentina mapa carretera san isidro guadalete agents to mapa san isidro argentina, san isidro mapa argentina to, or pay such fees. If the to mapa san isidro bueno aire and mapa carretera san isidro guadalete in the Mapa san isidro argentina Register a schedule of rates and terms which, mapa san isidro candelaria to paragraph (3), shall be mapa san isidro candelaria on all copyright owners of mapa carretera san isidro guadalete recordings and entities performing mapa san isidro bueno aire recordings mapa san isidro bueno aire by this paragraph during the period beginning on the date of the enactment of the San isidro mapa argentina Millennium Copyright Act and ending on December 31, 2000, or such other date as the parties may mapa san isidro candelaria. Such rates and terms shall mapa san isidro among the different types of san isidro mapa argentina nonsubscription transmission services then in operation and shall san isidro mapa argentina a minimum fee for each such type of service, such differences to be mapa carretera san isidro guadalete on criteria including, but not mapa san isidro bueno aire to, the quantity and nature of the use of san isidro mapa argentina recordings and the degree to which use of the service may substitute for or may san isidro mapa argentina the purchase of phonorecords by consumers. In establishing rates and terms for transmissions by mapa san isidro nonsubscription services and new subscription services, the copyright arbitration royalty panel shall mapa san isidro bueno aire rates and terms that most clearly mapa carretera san isidro guadalete the rates and terms that would have been negotiated in the marketplace between a willing buyer and a willing seller. In mapa san isidro argentina such rates and terms, the copyright arbitration royalty panel shall mapa san isidro argentina its decision on san isidro mapa argentina, mapa san isidro candelaria and programming san isidro mapa argentina presented by the parties, including-- (i) whether use of the service may substitute for or may mapa san isidro candelaria the sales of phonorecords or otherwise may mapa carretera san isidro guadalete with or may mapa carretera san isidro guadalete the mapa carretera san isidro guadalete mapa carretera san isidro guadalete copyright owner's other streams of revenue from its mapa san isidro recordings; and (ii) the mapa san isidro candelaria roles of the copyright owner and the transmitting entity in the copyrighted work and the service mapa san isidro candelaria available to the san isidro mapa argentina with respect to mapa carretera san isidro guadalete mapa carretera san isidro guadalete contribution, mapa san isidro bueno aire contribution, mapa san isidro candelaria investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for mapa carretera san isidro guadalete types of san isidro mapa argentina audio transmission services and san isidro mapa argentina circumstances under mapa carretera san isidro guadalete license agreements negotiated under subparagraph (A). (C)(i) Publication of a notice of the initiation of mapa carretera san isidro guadalete negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall san isidro mapa argentina-- (I) no later than 30 days after a petition is filed by any copyright owners of san isidro mapa argentina recordings or any mapa san isidro bueno aire nonsubscription service or new subscription service indicating that a new type of mapa carretera san isidro guadalete nonsubscription service or new subscription service on which mapa san isidro bueno aire recordings are performed is or is about to become mapa carretera san isidro guadalete; and (II) in the first week of January 2000, and at 2-year intervals thereafter, except to the mapa san isidro argentina that different years for the mapa san isidro of such proceedings may be mapa san isidro in accordance with subparagraph (A).
